Privacy Policy

1. Privacy is important to Civic Lane

This policy sets out how the Civic Lane Limited (“Civic Lane”) manages personal information, including sensitive information, that may be collected for one or more of the functions or activities of its core business or submitted to it through any of its websites or via any other means of collection.

This policy applies to Civic Lane and its directors, officers and employees (whether permanent, full-time, part-time or on a contractual arrangement), and to outsource service providers which collect personal information on behalf of Civic Lane.

2. New Zealand Law

Civic Lane is bound by the Privacy Act 2020 (“Privacy Act”). Unless Civic Lane has direct permission to do otherwise, it will only collect and use personal information as set out in this policy. Civic Lane takes the protection of personal information seriously.

The type of personal information Civic Lane collects and stores may differ for customers, service providers and prospective employees, but may include the individual’s name, current addresses, date of birth, age or age group, occupation, information about previous transactions and dealings with Civic Lane, email address, telephone/mobile phone number, fax number and personal correspondence, which includes emails.

Civic Lane may collect personal information through its website and through communication (either by email, telephone, in writing or in person). It may also collect personal information about you from third party administrators or service providers.

5. Why personal information is collected, used and disclosed

Civic Lane develops and sells various real estate property and services to its purchasers and investors.

Civic Lane collects personal information for the purpose of:

  1. keeping records of its transactions for business purposes or to enable it to respond to concerns;
  2. responding to inquiries;
  3. enhancing investor or client relations and investment opportunities; and
  4. in relation to prospective purchasers.

Where possible, personal information will only be used or disclosed for the primary purpose for which it was collected (or a related purpose) unless consent is provided to that other purpose of which Civic Lane is permitted to do so by law. In certain circumstances, Civic Lane may disclose personal information for a secondary purpose (see section 7 below).

Occasionally Civic Lane requires external organisations to provide a service for purposes which are necessary to conduct the functions or activities of its core business. Civic Lane will take such steps as are reasonable in the circumstances to ensure these organisations both inside and outside of New Zealand deal with personal information in accordance with this policy and the Privacy Principles. The organisations to whom Civic Lane discloses personal information may be located outside New Zealand. It is not practicable to identify the countries in which recipients are likely to be located.

Civic Lane may from time to time use certain personal information as part of improved investor relations or for direct marketing purposes that they think will be useful. Civic Lane may contact individuals by mail, telephone, email or SMS. Any marketing communications will include details of how to opt-out.

6. Websites

The type of information collected when visiting the One Greys Avenue website includes an individual’s IP address, the date and time of visit, the pages accessed and the documents retrieved (although information about activity on One Greys Avenue website is not used to identify anyone personally, unless required by law) and the type of browser used.

When visiting One Greys Avenue website, its server may attach a small data file known as a “cookie” to the visitor’s hard drive. This enables Civic Lane to analyse usage patterns on its website in order to tailor it to its users’ needs. This policy does not extend to use of these websites and individuals should refer to the respective privacy policies of such websites.

7. Security and retention of personal information

Civic Lane takes such steps (if any) as are reasonable in the circumstances to keep personal information secure in a combination of secure computer storage, hard copy files and other records to protect the personal information held from misuse, interference, loss, unauthorised access, modification or disclosure.

8. Access to and correction of personal information

An individual has the right to access personal information provided to Civic Lane by contacting Civic Lane using the details below (subject to certain legal exceptions). If an individual requires details of their personal information held by Civic Lane, Civic Lane will need to verify the individual’s identity before meeting the request, which will be processed in a reasonable time. Civic Lane will take such steps as are reasonable in the circumstances to give access in a way that meets the needs of both Civic Lane and the individual. In some circumstances under the Privacy Act and other legislation, Civic Lane may decide not to provide an individual with the access requested (for example, if it is unlawful to give the individual access or the request is frivolous or vexatious). If a legal exception applies and Civic Lane decides not to provide that individual with access to any personal information held about them, Civic Lane will advise that individual of the outcome of the decision.

Alternatively, if an individual believes that any information Civic Lane holds about them is inaccurate, out-of-date, incomplete irrelevant or misleading and needs to be corrected or updated, please contact Civic Lane using the details below. Civic Lane will take such steps as are reasonable in the circumstances to correct it and notify any related bodies corporate of the corrections. If Civic Lane does not agree to change the personal information held about that individual, and that individual still believes that it is inaccurate, out-of-date, incomplete, irrelevant or misleading, they may ask Civic Lane to attach a statement to this effect to the record. If Civic Lane decides not to correct an individual’s information, it will give the individual reasons for its decision.

If Civic Lane holds personal information that is no longer needed, they will take steps as are reasonable in the circumstances to remove any personal identifiers and de-identify that personal information or they will ensure the secure destruction of the personal information. However, Civic Lane may have commercial or legal obligations to maintain records for a minimum period (e.g. identification information may be retained in accordance with the Anti-Money Laundering and Counter-Terrorism Financing (“AML/CTF”) Act 2006 (Cth)).

9. Changes to Civic Lane’ privacy statement

From time to time, it may be necessary for Civic Lane to review and revise this policy, in whole or in part, in its sole discretion. Civic Lane reserves the right to change its policy at any time and to provide notice by publishing an updated version on Civic Lane’ website. Any changes will be effective immediately upon the posting of the revised policy on Civic Lane’ website. By continuing to access Civic Lane’ services following any changes, an individual will be deemed to have agreed to such changes.
